To: St. Louis County Presiding Judge Michael Burton Circuit Judge Div. 16 314-615-1516

Disqualify Judge Joseph Dueker from hearing Criminal Matters in St. Louis County,Mo.

Judge Burton should permanently ban Judge Dueker from hearing any criminal cases in St. Louis County, Mo due to his conflict of interest.

Why is this important?

On June 2nd, Florissant, Mo Police Officer Joshua Smith was caught on video running over an unarmed black man while driving an unmarked police vehicle. Officer Smith then preceded to jump out the vehicle and pin down the young man while punching him numerous times. Officer Smith was charged with Assault 1st Degree and Armed Criminal Action. The normal bond setting for these offenses is One Hundred Thousand Dollars Cash Only. Judge Dueker set Officer Smith's bond at $50,000.00 10%. Officer Smith posted a $5,000.00 bond and was released before the Prosecutor's office publicly announced he was being charged.
Judge Dueker's wife, Jane Dueker is a well known lobbyist for the Fraternal Order of Police, St. Louis Police Officers Association and St. Louis County Police Officers Association which includes the Florissant Police Dept where Officer Smith worked. This is a conflict of interest and the incredibly low bond Judge Dueker issued shows his inability to Judge criminal cases adequately and his favoritism towards police.
In addition per Missouri Statute the Victim was not notified of the bond setting, Victim was not notified Officer Smith was being released and the Victim was not given the right to reasonable protection from Officer Smith's possible harm or threat arising out of the victims cooperation with law enforcement and prosecution efforts.
